Terms of Use for Meta Platform Integrations

1. Parties and subject
1.1. These Terms are an agreement between FRIDAY HOLDING, TOO (BIN 230140044231; Kazakhstan, Almaty, Bostandyk district, Abay avenue 52, office 802-65, 050008; "we", "us") and the business that connects a Meta platform channel to the RevBack service (the "Customer").
1.2. We own the RevBack app on Meta platforms and operate the Instagram, Facebook and WhatsApp channels in the RevBack service (the "Channels"): receiving messages and comments addressed to the Customer, showing them to the Customer's team and sending the Customer's replies. Channels become available as each integration is released and the platform grants the required access.
1.3. The owner of the Customer's account accepts these Terms by ticking a box in the RevBack interface when the first Channel is connected. Acceptance covers all Channels in all projects of the account. We record the date, time, account, the person who accepted and the version of the Terms.
1.4. The Customer receives access to the RevBack service under the service agreement it entered into at registration (the "Offer"). No separate fee is charged for the Channels under these Terms; the service fee is paid under the Offer. Terms not defined here have the meaning given in the Offer.
2. Processing on the Customer's behalf
2.1. The Customer is the controller of the personal data of the people who write to it through the Channels. The Customer determines the purposes of processing and is responsible for having a lawful basis for it.
2.2. The Customer instructs us to process the data received through the Channels: messages and attachments, comments, the person's name and platform identifier, profile picture, phone number (for WhatsApp), and delivery and read receipts.
2.3. The purpose of processing is to operate the Channels in the RevBack service for the Customer: receiving, storing, displaying and sending messages and, if the Customer has turned on the optional AI features, suggesting draft replies, analysing conversations, assessing conversation quality and maintaining the Customer's own knowledge base. We process the data only on the Customer's behalf and at its direction, and not for our own purposes.
2.4. The Customer agrees that the following service providers take part in the processing:
(a) Individual Entrepreneur Denis Safiulin (Russia), who operates the RevBack service, its servers and databases on our behalf;
(b) infrastructure providers, for hosting and data transmission;
(c) the AI provider (Anthropic, PBC, United States), listed at revback.ai/subprocessors (in Russian), only if the Customer has turned on AI features. Service providers are required to follow the data processing requirements of these Terms.
2.5. Data is stored in databases located in the Russian Federation. Data of different Customers is kept separately.
3. Connecting a Channel
3.1. A Channel is connected only through the platform's own authorization. We do not request or store the login or password of a Meta platform account.
3.2. The Customer connects only accounts, pages and numbers it is authorized to manage.
3.3. The Customer may disconnect a Channel in the RevBack interface at any time. Disconnecting stops messages from being received and sent through the Channel.
3.4. Conversations that took place in a Channel before it was connected to RevBack are not imported.
4. What the Customer must not do
The Customer must not process data received through the Channels in a way that violates the rules of Meta platforms, and in particular must not:
(a) sell, license or distribute such data;
(b) use it for advertising or audience targeting;
(c) build or augment profiles of people without their consent;
(d) share it with third parties;
(e) use it to make eligibility determinations about people, including for hiring, dismissal, pay, credit, insurance, housing, education, government benefits or immigration status;
(f) use it for surveillance.
5. Messaging rules
5.1. The Customer messages people through the Channels only where it has a lawful basis and any opt-in required by the platform's rules, and immediately honours a person's request to stop receiving messages, including a request received outside the platform.
5.2. The platform limits the time during which a business may reply after a person's last message. Sending messages outside that window is not possible or is restricted by the platform's rules; we are not responsible for this.
5.3. The Customer does not ask for or share payment card numbers, financial account numbers or other payment data in the Channels.
5.4. The Customer does not use the Instagram and Facebook Channels for conversations between healthcare providers and patients or to collect health information.
5.5. The Customer follows the Meta platform rules that apply to its business and is responsible for its staff following them.
6. AI features
6.1. AI features are turned off by default. If the Customer has accepted the AI Features Terms (revback.ai/ai-terms, in Russian) and turned AI features on, they apply to conversations from the Channels on those terms, subject to this section.
6.2. Data received through the Channels is not used to create, develop, train or improve machine learning or artificial intelligence models, either our own or third-party. Adding to the Customer's knowledge base is not model training: the model is not changed, and what is learned is stored in the Customer's project, used only there and deleted together with it.
6.3. Data received through the Channels is not used for the service's internal analytics and is not kept as aggregated figures after it is deleted.
6.4. Conversation assessments and per-team-member figures are advisory. The Customer does not use them as a basis for the decisions listed in clause 4 (e).
6.5. Copies of requests sent to the language model and of its responses, and the AI call log, are kept for 90 days, to handle the Customer's requests about how the AI features worked.
7. Platform requests
7.1. We suspend or terminate a Customer's use of a Channel if the platform requests it or if this is necessary to comply with the platform's rules, and we inform the Customer.
7.2. We promptly notify the Customer of any communication we receive from the platform concerning a person's request about the processing of their data.
7.3. The scope of processing of data received through the Channels is changed only after the platform approves the change.
8. Data deletion
8.1. Data received through the Channels is deleted:
(a) at the Customer's request, to the extent stated in the request;
(b) at the request of the person the data relates to: we pass the request to the Customer and delete the data once the Customer confirms; if the Customer does not reply within 10 business days, or refuses without naming a legal duty to keep the data, we delete the data ourselves and inform the Customer;
(c) at the platform's request;
(d) when the Customer's project or account is deleted and when the agreement ends;
(e) when the data is no longer needed to provide the service to the Customer; disconnecting a Channel is not such a case;
(f) when the Channel is no longer supported in the RevBack service.
8.2. Disconnecting a Channel does not delete its conversation history; the Customer may request its deletion. Deleting a project or an account in the RevBack interface is an instruction to delete its data. Deleting a single message hides it in RevBack; it is removed from the database together with the project or at the Customer's request.
8.3. Data is deleted from the main database within 10 (ten) business days: from the day the case in clause 8.1 occurs; at the Customer's request, from the day we receive it; at a person's request, from the day the Customer confirms it or, if the Customer does not reply or refuses without naming a legal duty to keep the data, from the day the Customer's time to reply expires. Data is deleted from backups no later than 30 days after deletion from the main database. Data that the law requires us to keep is kept for the period the law sets.
8.4. How to request deletion is described in the Privacy Policy for Meta Platform Integrations (revback.ai/en/integrations/privacy).
9. The Customer's duties as controller
9.1. The Customer tells the people who write to it through the Channels that their data is processed using the RevBack service and obtains their consent where required. Where consent is the basis for processing, it names us, Individual Entrepreneur Denis Safiulin and the AI provider listed at revback.ai/subprocessors (in Russian), and states that infrastructure providers are engaged.
9.2. The Customer performs its own duties as a data controller under the law of its country, including those relating to cross-border data transfers.
10. Liability
10.1. We are not responsible for the actions of Meta platforms, including restriction or blocking of the Customer's accounts, pages and numbers, changes to platform rules and terms, and platform outages.
10.2. Our liability under these Terms is limited to the amount the Customer paid for the RevBack service for the last paid period; lost profit is not compensated. The limit does not apply to wilful breach or where the law does not allow liability to be limited.
10.3. The Customer reimburses us for documented losses arising from claims by platforms and third parties caused by the Customer's breach of sections 4 and 5.
11. Term and changes
11.1. These Terms apply from acceptance until all Channels are disconnected and the data received through them is deleted, or until the agreement under the Offer ends.
11.2. We may change these Terms by notifying the account owner through the RevBack interface and by email at least 15 days before the changes take effect. The account owner confirms the new version in the RevBack interface. A Customer that does not agree disconnects the Channels before the changes take effect, in the RevBack interface or by writing to support@revback.ai.
12. Governing law and disputes
These Terms are governed by the law of the Republic of Kazakhstan. Disputes are first handled by written claim (sent to support@revback.ai, reply within 10 business days) and, if not resolved, by the court at our registered location.
13. Language
These Terms are made in Russian and English. If the versions differ, the Russian text prevails.
